Terms of Service

These Terms of Service (“Terms”) govern your use of the websites, dashboard, and services provided by Krause Web Design (KWD), a division of Krause House LLC (“we,” “us”). By engaging our services or using your client dashboard, you agree to these Terms.
Our services
We design, build, host, and maintain websites and related online tools for local businesses, and we provide a dashboard through which you can manage content and connected services. The specific deliverables, build fee, and ongoing plan for your project are set out in the written agreement you sign with us, which works together with these Terms.
Accounts
You are responsible for keeping your account credentials secure and for activity under your account. You agree to provide accurate information and to keep it up to date. You must have the authority to act for the business you represent.
Fees, billing, and subscriptions
Build fees and recurring care/hosting plan fees are described in your agreement. Recurring fees are billed in advance on a recurring basis through our payment processor and continue until canceled. Build fees and deposits are non-refundable once work has begun, except as required by law or as stated in your agreement. If a payment is past due, we may suspend services until the balance is resolved.
Connected services (Google and others)
Some features let you connect third-party accounts, such as your Google Business Profile. When you connect an account, you authorize us to act on your behalf only for the features you enable, and your use of those third-party services remains subject to their own terms. You may disconnect a connected account at any time.
Your content
You retain ownership of the content you provide (text, images, logos, business information). You grant us the license needed to host, display, and use that content to provide the services. You represent that you have the rights to the content you provide and that it does not infringe others’ rights or violate any law.
Acceptable use
You agree not to use our services for unlawful, deceptive, or abusive purposes, to publish content you do not have the right to publish, or to interfere with the operation or security of our systems. You agree to follow the policies of any connected platform, including Google’s content policies for Business Profile posts.
Intellectual property
The KWD platform, templates, code, and design systems remain our property. On full payment, you own the finished website deliverables and your content as described in your agreement.
Warranty and disclaimers
We stand behind our work and provide a warranty period as stated in your agreement. Beyond that, the services are provided “as is” without warranties of any kind, to the fullest extent permitted by law. We do not guarantee specific search rankings, traffic, or business results.
Limitation of liability
To the fullest extent permitted by law, Krause House LLC will not be liable for indirect, incidental, or consequential damages, and our total liability for any claim will not exceed the amounts you paid us in the three months before the claim arose.
Termination
You may cancel a recurring plan at any time, effective at the end of the current billing period. We may suspend or terminate services for non-payment or violation of these Terms. On termination, we will provide reasonable assistance to help you transition your website and domain, as described in our guides.
Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Disputes will be handled in the state or federal courts located in Virginia.
Changes to these Terms
We may update these Terms from time to time. We will post the updated version here and revise the effective date above. Continued use of our services after a change means you accept the updated Terms.
